Miller: Judge Vinson's Decision a Victory for Our Constitution

Harrison Township, MI – U.S. Congresswoman Candice Miller (MI-10) today issued the following statement in response to Federal Judge Roger Vinson’s ruling that the individual mandate included in the Obamacare law is unconstitutional:

“Judge Vinson’s ruling is a victory for our Constitution,” Miller said. “I voted against Obamacare, and recently was proud to vote in favor of the repeal bill which overwhelmingly passed the House of Representatives. I have always believed that Obamacare exceeds the limits of the Constitution, costs too much and is funded with job destroying new taxes. There is no dispute that the Constitution empowers the federal government to regulate interstate commerce, but I agree with Judge Vinson’s conclusion that the individual mandate included in Obamacare goes too far by forcing citizens to participate in interstate commerce against their will. If this provision were allowed to stand, it would expand federal power to force individuals to purchase anything the federal government desired which would be a profound intrusion on the personal lives of every American.

“Judge Vinson’s decision also invalidated the Obamacare law in its entirety, because the individual mandate was central to the scheme envisioned by the legislation. It is time for the Administration and Democrats in Congress to abandon the overreach of Obamacare and work toward passing a Constitutional reform of health care which will deal directly with the issues most important to Americans. We must work toward lowering health care costs and expanding accessibility by unleashing the power of free markets instead of relying upon job destroying taxes, federal government overregulation, mandates and unconstitutional intrusions on individual freedom.”
